Practice Areas
Heather’s areas of practice include litigation relating to intellectual property. Heather appears regularly before the Federal Court of Canada and the Superior Court of Ontario. Her litigation experience covers patents, trade-marks and copyrights. Her focus is primarily on health technologies, including pharmaceuticals. Heather has been involved in all aspects of Notice of Compliance proceedings. She has also represented clients in litigation involving infringement and invalidity of pharmaceutical and other patents.
Organizations
Heather is an active member of the Canadian and Ontario Bar Associations, the Toronto Intellectual Property Group, the American Bar Association (IP Section), AIPPI and other intellectual property organizations.
Seminars and Publications
Heather has written a number of papers and book reviews on issues in intellectual property law. These works include such topics as litigating in the Federal Court of Canada, generic drugs and the developing world and global intellectual property rights.
Credentials
Heather received her B.A. (Ethics, Society and Law) from Trinity College, University of Toronto in 1996 and her LL.B. from University of Toronto Law School in 1999. Heather was called to the Ontario bar in February 2001 and then received her LL.M. from University of Toronto Law School in 2005. Her thesis examined Canada’s amendments to the Patent Act (to allow for the export of generic drugs to developing countries) with a view to whether or not the amendments will have any impact on AIDS epidemic in sub-Saharan Africa.
