On August 28, 2015, the United States International Trade Commission (Commission) issued a notice of its determination (decision) that Microsoft Inc (Microsoft) 3G mobile devices do not infringe two patents owned by Interdigital Communications Corp (Interdigital), and therefore, would not be blocked from importation into the US under section 337 of the US Tariff Act of 1930. The decision reverses the presiding administrative law judge’s initial determination on remand on the issues of claims construction and infringement - determinations which ultimately led the administrative law judge to recommend an import ban.
The decision ends a lengthy dispute before the Commission initiated by Interdigital against Nokia Inc (Nokia) prior to Microsoft’s acquisition of Nokia.
