Recently, a jury acquitted ElcomSoft on charges under the Digital Millennium Copyright Act ("DMCA") relating to designing and marketing software that could be used to crack Adobe System's eBook copyright protections and for conspiring to do so. In order to convict under the criminal provisions of the DMCA, it must be shown that company representatives willfully violated the law. While the jury agreed that the company's product was illegal, they believed that ElcomSoft did not willfully violate the law. The jury foreman commented that the jury panel had found the DMCA confusing. This made it easy for the panel to believe that ElcomSoft executives from Russia might not have fully understood its provisions.
