On October 20, 2023, the Government of Canada released the text of proposed amendments to Part 1 of Bill C-27, the Consumer Privacy Protection Act (CPPA).
These amendments primarily address the following areas:
- recognizing the right to privacy as a fundamental right through revising the Preamble of the Bill and Section 5;
- recognizing and reinforcing the protection afforded to children by amending the Preamble of the Bill and Section 12; and
- increasing the flexibility for the Office of the Privacy Commissioner of Canada to reach “compliance agreements”, while concurrently working to ensure that this does not impact an individual’s private right to action (through amendments to Sections 87, 93, and 107).
The Government of Canada remains open to receiving feedback on the proposed amendments along with considerations for additional amendments that may be identified.
